Terms of Service
1. Scope
These Terms of Service ("Terms") govern the use of the platform yoga-journaling.com and all related services (the "Platform") by you (the "User"). The Platform is operated by:
c/o Panda und Pinguin GmbH
Neptunstrasse 20
8032 Zurich
Switzerland
UID: CHE-396.021.246
referred to as "Yoga Journaling" or "we"
By registering an account you accept these Terms. Any conflicting terms on your side apply only if we have expressly agreed to them in writing.
2. Subject of the Agreement
Yoga Journaling provides an online platform for yoga teachers to plan, create, archive and export yoga sequences ("Flows") as PDFs. Depending on the chosen plan, the Platform includes in particular:
- A Pose Library with over 190 illustrated asanas
- The Flow Builder for creating your own sequences
- The Flow of the Month as monthly inspiration
- PDF export in A4 and Letter format
- An integrated teaching calendar
- Optional: personal branding on PDFs (Pro, Mentor)
- Optional: personal flow review by Karin Baltisberger (Mentor only)
3. Plans and Prices
Yoga Journaling offers three plan tiers: Creator, Pro and Mentor. The current prices and features are listed on our Pricing page.
All prices are stated in Swiss francs (CHF) or euros (EUR), inclusive of statutory value added tax where applicable.
4. Free Trial
We offer new users a free 7-day trial. During this period you have full access to the Platform. No credit card is required for the trial. After the 7 days the access ends automatically unless you start a paid subscription.
5. Conclusion of Contract and Payment
The contract is concluded when you start a paid subscription within the Platform. You can choose between monthly and yearly billing.
Payment is made in advance via our payment provider Stripe. We accept common credit cards as well as other payment methods supported by Stripe. Invoices are made available to you electronically.
In case of late payment we reserve the right to temporarily suspend access to the Platform until the outstanding amount has been paid in full.
6. Price Changes
We may adjust our prices from time to time, for example to reflect changes in operating costs, scope of features or applicable taxes. Any price change will only become effective at the start of the next billing period:
- If you have a monthly subscription, a new price applies from your next monthly renewal at the earliest.
- If you have a yearly subscription, a new price applies only from your next yearly renewal — the price you signed up for is locked in for the full year you have already paid for.
We will inform you of any price change by email at least 30 days before the change takes effect, so you have ample time to decide whether to continue with the new price or to cancel before the next renewal. If you do not cancel, the new price applies from the next billing period onwards.
7. Term and Cancellation
The subscription renews automatically for the same period (monthly or yearly) unless cancelled before the end of the current billing period.
You can cancel your subscription at any time through your account settings. The cancellation takes effect at the end of the current billing period. Amounts already paid are not refunded.
We may terminate the contract for cause at any time without notice, in particular in the event of a breach of these Terms.
8. Plan Changes
You can change your plan at any time. When upgrading to a higher plan, the price is calculated pro rata for the remainder of the current billing period. When downgrading, the change takes effect at the end of the current billing period; amounts already paid are not refunded.
9. Usage Rights and Content
9.1 Yoga Journaling content
All content on the Platform — in particular the pose illustrations, the Flow of the Month, templates, texts and design — is protected by copyright and remains the property of Yoga Journaling or its licensors. You receive a simple, non-transferable right to use this content for your own yoga classes.
Any redistribution, commercial dissemination, reproduction or making available to the public of the content — outside the intended use within your own yoga practice and teaching — requires our prior written consent.
9.2 Your own content
Content you create yourself on the Platform (your own flows, notes, calendar entries, uploaded logos) remains your property. You grant us only the technically necessary right to store, display and make this content available to you.
You confirm that you hold the necessary rights to any content you upload (e.g. logo, profile picture) and that you do not infringe on any third-party rights.
10. User Obligations
You agree to:
- provide truthful information when registering
- keep your password safe and not share it with third parties
- not misuse the Platform, in particular not attempt to bypass technical protection measures
- not upload content that violates applicable law or third-party rights
11. Availability
We aim for the highest possible availability of the Platform but do not guarantee uninterrupted access. Maintenance work, technical issues or updates may result in temporary limitations. Planned maintenance windows will be announced in advance where possible.
12. Liability
We are liable only for intent and gross negligence. Liability for slight negligence is excluded to the extent permitted by law.
Yoga Journaling is a planning and inspiration platform for yoga teachers. Responsibility for the correct and safe execution of yoga classes lies entirely with the teacher in charge. Yoga Journaling assumes no liability for injuries or damage arising in connection with the application of sequences planned through the Platform.
13. Changes to These Terms
We may update these Terms, for example to reflect new features or legal changes. We will notify you of any material changes at least 30 days in advance by email. If you do not object, the new Terms are deemed accepted. In the event of an objection, you have a right of extraordinary cancellation.
14. Governing Law and Jurisdiction
These Terms are governed exclusively by Swiss law, excluding its conflict of laws provisions and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction for any disputes arising from or in connection with this contract is Zurich, Switzerland. Mandatory consumer jurisdictions remain reserved.
15. Severability
Should any provision of these Terms be invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a regulation that comes closest to the economic purpose of the invalid provision.
